All capitalized terms used but not defined herein have the meaning set forth in the commercial services agreement and/or terms between User Interviews, Inc. (“UI”) and Customer. UI reserves the right to modify this Acceptable Use Policy at any time in its sole discretion.
1. No Disruption of the Services. Customer will not, and will not authorize or facilitate any attempt by another person to:
a) Attempt to gain unauthorized access to the Services or any data;
b) Modify, disable, or compromise the integrity or performance of the Services;
c) Circumvent, remove, or otherwise interfere with any security-related features or authentication measures within the Services;
d) Damage, tamper with, reverse engineer, or hack the Services;
e) Overburden, impair or interfere with any other party’s use of the Services;
f) Introduce viruses, worms, time bombs, Trojan horses, malicious code, or other malware to the Services; or
g) Use any robot, spider, site search/retrieval application or other automated device, process, or means to access, retrieve, scrape, or index any portion of the Services.
2. No Inappropriate Communications. Customer will not, and will not authorize or facilitate any attempt by another person to, use the Services to generate or send:
a) Unsolicited communications, advertising, spam, or commercial or marketing messages of any kind;
b) Any communication that disparages UI or its partners, vendors, or affiliates; or
c) Any communication that (i) does not identify Customer accurately and in a non-deceptive manner, (ii) contains any deceptive or misleading content regarding the message’s subject matter, (iii) does not include Customer’s valid physical address, or (iv) otherwise fails to comply with applicable law.
3. No Inappropriate Content. Customer will not, and will not authorize or facilitate any attempt by another person to, submit any content to the Services that:
a) Infringes UI’s or a third party’s intellectual property or other rights, including any copyright, trademark, trade secret, patent, right of publicity, or any other proprietary or contractual right;
b) Is unlawful, deceptive, fraudulent, threatening, abusive, harassing, hateful, disparaging, defamatory, libelous, harmful to minors, vulgar, offensive, obscene, pornographic, lewd, lascivious or otherwise objectionable, as determined by UI in its sole discretion;
c) Encourages conduct that would constitute a criminal or civil offense;
d) Depicts or advocates the use of illegal drugs, or characterizes violence as acceptable, glamorous, or desirable; or
e) Attacks others based on their race, ethnicity, national origin, religion, sex, gender, sexual orientation, disability, or medical conditions.
4. No Wrongful or Harmful Behavior. Customer will not, and will not authorize or facilitate any attempt by another person to:
a) Use the Services for any illegal purpose;
b) Create a false identity or otherwise use false or misleading information in connection with Customer’s account;
c) Engage in fraudulent activities, including by “spoofing,” “phishing,” manipulating headers or other identifiers, impersonating any other person, or falsely implying any sponsorship or association with UI or any third party;
d) Use the Services to invade the privacy of any person, including without limitation publishing or posting private or confidential information about a person without their consent, or collecting or gathering personal information about a person through any means not intentionally made available through the Services; or
e) Use the Services to harass, threaten, stalk or intentionally embarrass or cause distress to another person.
